Re: Braemer Towers Mandatory Disclosure

To:  ALL Coastal Association Members and Brokers of Record
From:  Coastal Association of REALTORS®, Inc.
Date:  April 7, 2005

Please be advised that our legal counsel, Al Monshower, has stated that the existence of Legionnaires Disease at the Braemar Towers, is a material fact which a real estate licensee is required to disclose to all parties.

He is recommending that the disclosure be made in writing, and that it be made to any potential buyer and/or tenant prior to contract of sale. This disclosure should be made until such time as the appropriate county or city health department completes its treatment, inspection, and testing of the property and certifies that the cause of the Legionnaires bacteria has been remediated.

Please make sure that all of your agents are aware of this important issue.

Thank you for your attention to these important industry matters,

Elaine Gordy
CAR President
